Our role in the court process
PHHS assesses or investigates reports and works with families on safety and services. When court involvement is needed, our attorneys review the matter and may file a Child in Need of Protection or Services petition, often called a CHIPS petition. A petition asks the court to determine whether a child needs protection or services under Minnesota law.
Our attorneys present the County’s position in court. The judge makes decisions about the case, including whether court-ordered protection or services are necessary. When a child cannot safely return home, the court may also consider a permanent legal arrangement for the child.
If your family is involved in a case
Read the court notices you receive and keep track of hearing dates. Your social worker can answer questions about services and case planning. Your attorney can explain the legal process, advise you about your rights and represent your position in court.
The County Attorney represents PHHS. If you need your own lawyer, ask the court about requesting a court-appointed attorney. The court determines whether you qualify.
