Vulnerable Adults & Civil Commitments
Our attorneys work with County Public Health and Human Services on legal matters involving the protection of vulnerable adults and civil commitment. Adult protection and civil commitment are separate processes with different purposes and legal requirements.
Report suspected adult abuse or neglect
If someone is in immediate danger, call 911. To report suspected abuse, neglect or financial exploitation of a vulnerable adult, call the Minnesota Adult Abuse Reporting Center at 844-880-1574.
Some adults need additional protection because of a disability, illness, care needs or the services they receive. Adult Protection staff assess reports and work to address safety concerns. Our attorneys advise PHHS and may bring protective legal proceedings when warranted. Less restrictive options are considered when reviewing possible guardianship referrals.

Understanding civil commitment
Civil commitment is a court process that may result in court-ordered treatment when the requirements of Minnesota law are met. A diagnosis or a family’s concern does not, by itself, establish that commitment is appropriate.
The process generally includes a screening investigation, legal review and court proceedings. A County screening team gathers information and considers whether to recommend commitment. The County Attorney reviews the legal basis for a petition. The court decides whether the legal requirements are met and considers less restrictive alternatives.
The person who is the subject of the petition has the right to an attorney. The County Attorney does not serve as that person’s lawyer. If you are involved in a commitment case, your attorney can explain your rights and the court process.
